The cerebral cortex controls our most distinguishing higher cognitive functions. Human‐specific gene expression differences are abundant in the cerebral cortex, yet we have only begun to understand how these variations impact brain function. This review discusses the current evidence linking non‐coding regulatory DNA changes, including enhancers, with neocortical evolution. Functional interrogation using animal models reveals converging roles for our genome in key aspects of cortical development including progenitor cell cycle and neuronal signaling. New technologies, including iPS cells and organoids, offer (...) potential alternatives to modeling evolutionary modifications in a relevant species context. Several diseases rooted in the cerebral cortex uniquely manifest in humans compared to other primates, thus highlighting the importance of understanding human brain differences. Future studies of regulatory loci, including those implicated in disease, will collectively help elucidate key cellular and genetic mechanisms underlying our distinguishing cognitive traits. Congdon (2017), Giladi (2018), and McConkey (2004) challenge feminist epistemologists and recognition theorists to come together to analyze epistemic injustice. I take up this challenge by highlighting the failure of recognition in cases of testimonial and hermeneutical injustice experienced by victims of sexual harassment and sexual assault. I offer the #MeToo movement as a case study to demonstrate how the process of mutual recognition makes visible and helps overcome the epistemic injustice suffered by victims of sexual harassment and sexual assault. I argue that in declaring “me too,” the epistemic subject emerges in the context of a polyphonic symphony of victims claiming their status as agents who are able to make sense of their own social experiences and able to convey their knowledge to others. Social epistemologists use the term hermeneutical injustice to refer to a form of epistemic injustice in which a structural prejudice in the economy of collective interpretive resources results in a person’s inability to understand his/her/their own social experience. This essay argues that the phenomenon of unacknowledged date rapes, that is, when a person experiences sexual assault yet does not conceptualize him/her/their self as a rape victim, should be regarded as a form of hermeneutical injustice. The fact that the concept of (...) date rape has been widely used for at least three decades indicates the intractability of hermeneutical injustices of this sort and the challenges with its overcoming. Whether in the form of testimonial injustice, hermeneutical injustice, or contributory injustice, epistemic injustice is characterised an injustice rather than simply an epistemic harm because it is often motivated by an identity prejudice and exacerbates existing social disadvantages and inequalities. I argue that epistemic injustice can also be utlised against some members of privileged social identity groups in order to preserve the dominant status of the group as a whole. As a case-study, I analyze how the harms to male victims (...) of sexual violence is exacerbated by the failure of the law to recognise the rape of men as a crime and the failure of other people to recognise the testimony of male rape victims as credible. Analyzing shifts in the legal concept of rape and examples from Project Unbreakable, I uncover how these failures of recognition undermine the victims’ status as legal, moral, and epistemic subjects and inflict epistemic injustice against them. Although consumers and physicians alike have long described the goal of aesthetic surgery as the production of an “improved” but still “natural-looking” body, interviews with women who had cosmetic surgery between 1990 and 2007 suggest that the “artificial” is becoming increasingly prevalent within consumers’ narratives of breast enlargement. This article explores that change in relation to processes of conspicuous consumption, the growing cultural emphasis on continual self-transformation, and the increasing normalization of cosmetic modification. Following Fraser, it treats consumers’ accounts not (...) as the reflection of “reality” or a “true self” but instead as indicators of the kinds of options, expressions, assumptions, and perspectives that are available for use in communication about cosmetic surgery. The analysis also draws on feminist writings about the social construction of “breastedness” in femininity. In so doing, it seeks to conceptualize the cultural significance of breasts that are “too good to be real.”. (shrink)

Underlying theories of rape in legal philosophy are assumptions about the relationships between rights and property, self and others, mind and body, public and private domains, subject and object. Philosophers who study sexual assault by focusing almost exclusively on the law of rape often fail to interrogate their implicit ways of conceptualizing subjects and the harm done to them. In particular, these analyses often overlook the impact of rape on the development of personal identity and understanding of self. This project (...) provides an analysis of the wrongness of rape that considers rape not as a moment of nonconsent, but as a stage in an experiential process that includes, but is not limited to, the violation of rights. By integrating the philosophical methods of phenomenology and critical theory with current writings on the philosophy of rape law, rape trauma, and critical race theory, this study develops a descriptively full theory of rape that takes the experience of the survivor as the point of departure. A philosophically rich understanding of the harm of rape emerges when approaching the issue through the lived realities of women who have been subjected to sexual violence along with a critical social theory of how the social, historical, and material conditions inform that experience. We applied the moral dissonance reduction framework, used to explain the maintenance of a positive self-concept in dishonest behavior, to understand self-justification of prejudice. Participants identified ambiguously negative intergroup behaviors, then evaluated those behaviors when performed by others and themselves. As predicted by moral dissonance reduction, participants were less critical of their own behavior when considering others’ behaviors before their own. In a third study directly comparing prejudiced and dishonest behavior, participants’ responses showed the greatest self-justification in the initial question (...) about their behavior regardless of the content of the question, whereas subsequent questions showed more stability, consistent with the idea that participants adjusted their initial self-reports to avoid damage to their self-concepts. Employees’ may view prohibitive voice—that is, expressing concerns about harmful practices in the workplace—as a moral yet interpersonally risky behavior. We, thus, predict that prohibitive voice is likely to be influenced by variables associated with moral and relational qualities. Specifically, we hypothesize that employees’ moral identity internalization—i.e., the centrality of moral traits in their self-concept—is positively associated with their use of prohibitive voice. Furthermore, we hypothesize that this association is stronger when employees enjoy a higher quality relationship with their leader. (...) In addition, drawing on the literature on moral symbolism, we hypothesize that workgroup moral identity symbolization—i.e., the extent to which workgroup members symbolically display moral traits—moderates the relationship between moral identity internalization and prohibitive voice in a compensatory manner. That is, workgroup moral identity symbolization enhances employees’ use of prohibitive voice when employees’ moral identity internalization is low. Data collected from hospital employees and their supervisors and coworkers support these hypotheses. These findings suggest new ways to promote prohibitive voice and, thereby, protect organizational stakeholders from harmful behaviors. (shrink)

The tension between scientific openness versus secrecy has existed for centuries (Hull 1985). However, both academics and practitioners have recently argued that openness by private firms has many positive attributes. The purpose of this research effort is to review the extant literature on openness and to develop hypotheses regarding its impact on organizational outcomes. We then use a unique database to test the idea with 87 companies. Our findings are that openness is beneficial to the firm from a science, technological, (...) and financial perspective and, perhaps, to the employees from an ethical viewpoint. This field survey in a fast food restaurant setting tested the hypothesized influences of two social context variables (role responsibility and interests of group members) and justice evaluations (distributive, procedural, and retributive) on respondents' inclination to report theft and their theft reporting behavior. The results provided mixed support for the hypotheses. Inclination to report a peer for theft was associated with role responsibility, the interests of group members, and procedural justice perceptions. Actual reporting behavior was associated with the inclination to (...) report and with retributive justice evaluations. Implications for future research and for management are discussed. (shrink)

Using a survey of 393 employees who were natives and residents of China, Japan, and South Korea, we examined the extent to which employees from different countries within East Asia experience distributive justice when they perceived that their work outcomes relative to a referent other were equally poor, equally favorable, more poor, or more favorable. As predicted, we found that when employees perceived themselves relative to a referent other to be recipients of more favorable outcomes, Chinese and Korean employees were (...) less likely than Japanese employees to experience distributive injustice. We also found that these differences were partially mediated by employees’ level of materialism. Theoretical and practical implications of our findings are discussed. (shrink)

The upstream framework presented in public health and medicine considers health problems from a preventive perspective, seeking to understand and address the root causes of poor health. Medical-legal partnerships (MLPs) have demonstrated the value of this upstream framework in the practice of law and engage in upstream lawyering by utilizing systemic advocacy to address root causes of injustices and health inequities. This article explores upstreaming and its use by MLPs in reframing legal practice.

This article examines the construction of gender within men's accounts of domestic violence. Analyses of in-depth interviews conducted with 33 domestically violent heterosexual men indicate that these batterers used diverse strategies to present themselves as nonviolent, capable, and rational men. Respondents performed gender by contrasting effectual male violence with ineffectual female violence, by claiming that female partners were responsible for the violence in their relationships and by constructing men as victims of a biased criminal justice system. This study suggests that (...) violence against female partners is a means by which batterers reproduce a binary framework of gender. (shrink)

We affirm the utility of integrative modeling, according to which it is advantageous to move beyond “one-at-a-time binary paradigms” through studies that position themselves within realistic multidimensional design spaces. We extend the integrative modeling approach to a target domain with which we are familiar, the consequences of bilingualism on mind and brain, often referred to as the “bilingual advantage.” In doing so, we highlight work from our group consistent with integrative modeling.

Whether generated by old social standards or intensified by recent technology, these dilemmas all pose persistent, 'nagging,' questions that cry out for answers.

In a developing profession, emphasis is placed on two key ingredients for a successful climb to the executive suite — namely, interpersonal skills and an appropriate personality structure than can cope with forms of stress and uncertainty. The data presented in this study were collected from one of the major accounting firms and offers insights into men and women on the upward climb within the accounting profession. Analysis of this data shows that although appropriate personality characteristics are predicated on a (...) male managerial model, women and men perceive themselves similarly with respect to these characteristics. However, others' perceptions of women, male accountants as well as clients, seemed more skeptical of women's ability to succeed. Furthermore, there are indications that women and men have different job assignments along their career paths. Our data collected in the latter half of the seventies tend to corroborate many of the findings in the first half — in general women are not perceived as ready for the managerial climb. (shrink)

Cet article interroge la question des corpus en analyse multimodale des corpus oraux d’interactions filmées dans le cadre d’une linguistique qui intègre l’étude des gestes à celle du discours pour rendre compte des pratiques langagières dans leur globalité. Ce type d’approche est traditionnellement associé à des petits corpus supports d’analyses qualitatives. À l’appui d’un tour d’horizon de recherches contemporaines en analyse multimodale des interactions orales, nous montrons que l’étude linguistique des gestes se prête à une grande variété d’approches innovantes au (...) plan méthodologique. En pratique, il reste à ce jour difficile de construire des grands corpus pour l’analyse gestuelle, parce qu’il s’agit d’une entreprise longue et coûteuse (enregistrement, transcription, annotation) : les petits corpus sont nombreux parce qu’ils sont plus faciles à construire pour un chercheur seul ou une petite équipe de recherche aux moyens limités. Cette situation tend cependant à évoluer, et ce de plusieurs manières, grâce aux collaborations nationales et internationales et aux nouveaux outils numériques. Les « petits » corpus n’en restent pas moins sources de résultats précieux en analyse gestuelle. Pour diverses raisons, les standards internationaux de l’évaluation de la recherche tendent à valoriser l’analyse quantitative aux dépens de l’analyse qualitative, faisant oublier que ces deux types d’approches ont des objectifs certes différents mais complémentaires : ils permettent de répondre à des questions de recherche différentes (étroites ou larges) et de proposer des savoirs d’origines différentes (généralisabilité des résultats ou généralisabilité des processus observés), dont la légitimité est elle aussi de nature différente (réfutabilité des résultats ou consilience des experts). Nombre de travaux récents en analyse gestuelle encouragent à remettre en question la dichotomie traditionnelle entre analyses qualitatives et quantitatives, en intégrant les deux approches de diverses manières. Contributors to this volume consider the professional, philosophical, and personal backlashes against feminist thought, and reflect upon their ramifications. The conclusion is that the disdain and irrational resentment of feminism, even in higher education, amounts to a backlash against progress.

In his essay, “Negative and Positive Positivism,” Jules L. Coleman extends in two important ways the Legal Positivism of H. L. A. Hart. First, he shows that the “separability thesis”—the claim that no necessary or constitutive relationship exists between law and morality—to which Positivists are wedded does not entail the view, attributed by Ronald Dworkin to Legal Positivists, that law consists in “hard facts.” Instead, the separability thesis requires only the possibility of deciding the truth of propositions of law. This (...) weaker requirement can be met by rules of recognition that are semantically adequate but that fail to set out tests by means of which the legal status of rules and norms may be verified. Second, Coleman argues that one can subscribe to the separability thesis and still maintain that judges may have a legal duty to couch decisions in moral terms whenever the “content or proper formulation of [a] rule of recognition” is in dispute. Such a legal duty may exist in virtue of a convergent practice “among judges of resolving the controversy in a particular way”. (shrink)
